A Madrasa Housed in a Mosque Room: Its Rent to the Mosque
Question
(1) In the mosque of our neighbourhood there is a room in which the regular imam lived for a long time and taught children religion. On one occasion, when there was no imam, Zayd, at the request of ‘Umar, the mutawalli (trustee) of the said mosque, began leading the prayer without any agreement on a salary, and instead of living in that room himself he appointed a religious scholar to teach the children.
Answer
No agreement on a salary was made; therefore Zayd has no right whatsoever to demand a salary, especially since the prayer and the congregation were being held there even without a salaried imam. (2) ‘Umar has no authority to pay Zayd a salary for his past leading of the prayer from the mosque’s funds.
