Building a Mosque, a Well and a House with Unlawful Wealth
Question
Zayd keeps a shop in Africa and keeps impermissible goods in the shop — wine, pork and the like. With money accumulated from this business he had a well built in the graveyard of his home town, had a mosque built in Africa, and had a house built and put it in the name of the council of his community. What is the ruling on using all of these?
Answer
Is there also something permissible in Zayd’s shop, or are all the goods, like wine and pork, purely haram? If there is something permissible as well, then his income is composed of the haram and the halal, and through the mixing of haram with halal a person becomes the owner of the whole, even though liability (daman) for the haram is wajib upon him.
