The ruling on talaq when one calls one’s wife “mother”
Question
(1) A man, having become angry, said to his wife: «تم ہمارے گھر سے نکل جاؤ، تم ہماری ماں ہو اور ہم تمہاری اولاد، اگر تم نہیں جاؤ گی ہمارے گھر سے تو تم کو ماریں گے» (“Get out of our house; you are our mother and we are your children; if you do not leave our house, we will beat you”). The wife, frightened, went to another house and hid there; then, when his anger had cooled, she came back. Is this wife now lawful for this man or not? Moreover, several people heard all of this harsh language. (2)
Answer
«تم ہمارے گھر سے نکل جاؤ» (“Get out of our house”): if by these words he intended (niyya) talaq, an irrevocable (ba’in) talaq has taken effect; if he did not intend it, no talaq has occurred. «تم ہماری ماں ہو» (“you are our mother”): no talaq whatsoever has occurred by these words. In the case of an irrevocable (ba’in)
