Abducting a woman, and divorcing her for money
Question
Question: Khalid said to Zayd: “I will give you five hundred rupees; take five hundred from me, give Hinda talaq, and free yourself from the court case.” Thereupon Zayd, in order to obtain proof concerning Hinda, as a stratagem (hila), took five hundred rupees from Khalid, bought a one-rupee paper from a stamp-paper vendor and gave it to Khalid.
Answer
Khalid, by abducting Zayd’s wife, has committed a grave crime; and Zayd is entitled to recover from him in full whatever money he has spent in this connection. After one revocable (raj‘i) talaq the husband retains the right of taking back (ruju‘).
