Is the nikah annulled by making a ta‘ziya?
Question
Question: If Muslims, having heard the prohibiting ruling of the pure Shari‘a, do not comply and then make or place a ta‘ziya (a replica of the tomb of Imam Husayn carried in Muharram processions) in that same mosque, or raise noise and clamour near the mosque at the time of prayer and congregation, will their nikah become void or not?
Answer
Merely by not acting the nikah will not become void, although it will be a sin. Belittling and mocking any ruling of the Shari‘a is kufr, and by it the nikah is annulled.
