Nikah during the ‘idda after talaq
Question
Question: Hasan Muhammad Khan, because of the inattentiveness and sharp tongue of his wife by nikah, named Sardarni, gave her one talaq in January 1942. Then she was admonished; when she did not heed, a second talaq was given to her a month later. After that, in 1943, he gave her a third talaq in writing. Now my biradari (clan community) wants to settle Sardarni in my home again. What should be done now? That is all.
Answer
If after the second talaq he took her back (ruju‘) — that is, before the end of the ‘idda he withdrew the talaq and they began living as husband and wife — and then gave the third talaq, or if the third talaq was given before the end of the ‘idda of the second talaq, then she has now become mughallaza (divorced by a major divorce), and keeping this woman is haram.
