Wudu and the Like from a Well into Which Used Water Enters
Question
In the villages many people perform the ghusl of janaba and the like right at the well, and the used water (ma' musta'mal) falls into the well; moreover, women too perform ghusl very carelessly, and the used water falls into the well. Yet all needs are met from this well. So what is the ruling on using it for wudu and ghusl? Is it permissible or impermissible? Should it be regarded as pure or impure?
Answer
As long as it has not been established that impurity (urine, faeces, mani and the like) is falling into the well because of this drawing of water and bathing, the well will not be called impure (najis) on that account. Those who perform the ghusl of janaba there should be told to first purify the actual impurity (najasa haqiqiyya)
