Slaughtering above the knot (ʿuqda)
Question
Question: Bakr slaughtered a cockerel, and its trachea (hulqum) did not remain on the side of the mouth but moved back. What is the ruling on this: is this chicken lawful (halal), or reprehensible (makruh), or unlawful (haram)? Is it permissible to eat it or not? And what are the reasons why consideration is given to whether the trachea is cut at the front or at the back? Also, kindly set out the conditions and the wajib elements of slaughter, and write (the answer to) the question with proofs.
Answer
If the trachea (hulqum), the oesophagus (mari’) and the two jugular veins (wadajan) are cut, and the slaughterer is one of the people of religion (ahl al-din) and did not deliberately omit “bismillah”, then according to the Sharia the slaughtered animal is lawful. If the trachea is not cut, it is not lawful. If the slaughter is above the knot (ʿuqda), below the knot (?)
