Establishing Kinship Through Zina
Question
A man became defiled with his own daughter. As a result a girl was born, whom a certain widow brought up. The girl reached maturity and was married, and a girl was born of her. Now the one to whom this girl is being engaged is her maternal uncle, in that the mother of the adulteress had married a widower, from whom this boy was born. Now if the matter is disclosed as it truly is, there will be disgrace and dishonour. If it is not disclosed, is there any harm in this according to the Shari‘a?
Answer
The relationship of maternal uncle and niece between this boy and this girl does not exist from the standpoint of the Shari‘a, and there is no Shari‘a testimony for what is being related about this relationship. Therefore this match will not be called prohibited (haram).
