Combining in Marriage a Woman and Her Stepmother
Question
Bakr has a daughter, Zubayda, from his wife Hinda; this girl was married (her nikah was performed) to Zayd, and from this wife of Zayd, Zubayda, two children were born. In the meantime Bakr’s wife Hinda died, and he married Sakina, and a boy was born. After Bakr died, Zayd, while still having Zubayda, married Sakina, and a month later, at Sakina’s insistence, he divorced (gave talaq to) Zubayda. Is this nikah permissible according to the Shari‘a or not?
Answer
According to the Shari‘a this nikah is permissible. In al-Durr al-Mukhtar on the margin of Shami (vol. 2, p. 439, Book of Nikah, section on the prohibited women) it is stated: [ar]فجاز الجمع بين امرأة وبنت زوجها[/ar] “Hence it is permissible to combine in marriage a woman and her husband’s daughter.” In the case asked about, Zubayda is the daughter of Sakina’s husband (Bakr).
