Marriage with a Step-Maternal Uncle (the Stepmother’s Brother)

Question

Zayd has two grown-up daughters, but his wife has passed away. Zayd has married a second time. Is it now permissible to marry Zayd’s daughter to the brother of the second wife or not?

Answer

Marrying a girl to her maternal uncle is not valid. Here, however, the brother of Zayd’s second wife is not the maternal uncle of the daughter Zayd has from his first wife; this nikah is valid according to the Shari‘a.
