The Testimony of a Brother and a Sister’s Husband, and Discrepancy in the Witnesses’ Statements
Question
(1) Zayd is ‘Amr’s full brother. Zayd gives testimony in ‘Amr’s favour — about his benefit, not about his loss. Is Zayd’s testimony in ‘Amr’s favour, for his benefit, accepted according to the Shari‘a or not? (2) At the engagement gathering there were four witnesses — pious, respected men of standing — and two ordinary witnesses. The four witnesses say that after the offer (ijab) they did not hear the acceptance (qabul)
Answer
