Building a Second Eidgah to Remove Discord

Question

In one Eidgah (open ground for the Eid prayer) the Eid prayer had previously been held by common agreement; later a few men, on account of some discord, built a second Eidgah. In which Eidgah will the prayer now be held according to the Shari‘a, and will the second Eidgah not fall under the ruling of (the mosque of) dirar, or not?

Answer

Building a second Eidgah in order to create discord and division is impermissible. However, if discord has arisen for some reason and it is difficult to remove it except by building a second Eidgah, then building a second Eidgah is permissible. In any case, once that Eidgah has been built and duly made waqf, the prayer is valid in both — in it and in the first Eidgah.
