The Eid prayer in an endowed graveyard

Question

There is an endowed (waqf) graveyard here, surrounded on all four sides by a boundary wall. Most of the town’s dead are buried in this graveyard. Inside the graveyard some land is still vacant; the dead are buried in the land behind this vacant land, and when the need arises, the dead will also be buried in this vacant land in front. At present the town needs an Eidgah (open ground for the Eid prayer) for performing the Eid prayers.

Answer

Since the dead are buried in this graveyard and there are graves of every kind there, new and old, the Eid prayer should not be performed there. Rather, since there is a place near it and there is a proposal to buy it and make it an Eidgah, they should buy that very place and make it an Eidgah, and not cause discord and division over this.
