Are the shroud and the like the husband’s responsibility?
Question
The mourning expenses which, after Hinda’s death, are incurred as necessary by custom or by the Shari‘a — for example the shroud, charity and the like — will they be from Hinda’s estate (tarika), or will they be binding on the husband?
Answer
The shroud of a wife, according to the position on which the fatwa is given (mufta bihi), is binding on the husband: [ar]واختلف في الزوج، والفتوى على وجوب كفنها عليه[/ar] “There is disagreement concerning the husband, and the fatwa is on its being obligatory upon him to shroud her” (Tanwir al-Absar, vol. 1, p. 905).
