Killing both if the wife is involved in zina with a stranger
Question
Question: At present the establishment of Islamic rule is simply not possible. If a husband learns that his wife has committed zina with such-and-such a man, is it permissible to shoot both of them dead or not?
Answer
He should pronounce talaq and end the marital bond — so it is in “Sunan Abi Dawud”; this is the original ruling. However, if it is hard for him to manage without this wife, he may also keep her, as is found in that narration; and so it is in “al-Durr al-Mukhtar” as well. Killing, or causing death by means of sorcery (sihr), is not permitted.
