A dispute over a plot of land
Question
Question: Adjoining Zayd’s house there is some land, say twenty square feet, belonging to a certain Muslim, in the form of a useless ruin, and it has passed into the possession of the Custodian (the state custodian of evacuee property). The owner of this land was a Muslim who lives somewhere in Pakistan, and it is also difficult to find out who his relatives, kin or heirs present here are; and it cannot go to anyone, because the Custodian has given the land to a Sindhi.
Answer
Because the Custodian took possession of that land and gave it to the Sindhi in compensation, it left the ownership of the one who departed and became the property of the Sindhi. Now it is not permissible for Zayd, by making a false statement, to present it as his own land and, by presenting false proof through a lawsuit, to include it in his house.
