Recovering one’s own right
Question
Question: I, the humble one, took sick leave for fifteen days on half salary. It was also gazetted in the newspaper that the sick leave was sanctioned on half salary, but when I received my salary from the department I was given it in full: the half salary was not deducted, and it is a debt owed by me. Two years have passed since then. In this connection I submit: the land revenue, that is, the cash rent for land that the government collects from us every six months — is probably oppression (zulm) in the Shari‘a.
Answer
Recovering one’s own right is correct according to the Shari‘a: in whatever way it was taken, one may recover it in the same way, or by another means. But we do not know the situation of the Islamic princely state. It is not correct to draw an analogy (qiyas)
