Teachers Selling Examination Copybooks
Question
For the examinations of the elementary religious schools — quarterly, annual and so on — the students are made to prepare copybooks. After the examination the students hand these copybooks in to the teachers, or rather the teachers collect them, and then, when the opportunity arises, they sell them and use the proceeds themselves. Is this correct according to the Shari‘a?
Answer
If the students present them to the teacher as a gift (hadiyya), then, according to the rule of the Shari‘a, once the gift (hiba) is complete, it is permissible in the Shari‘a for the recipient of the gift (mawhub lahu) to put the value of the pages of these copybooks to his own use.
