Relocating a Madrasa to Another Place

Question

If a madrasa was moved to another place, or its name was changed in the interim and then the same name was given to it again, will the rector of the madrasa be held to account for any Shar‘i wrongdoing?

Answer

Moving a madrasa to another place without necessity is contrary to the purpose of the waqif, and fulfilling the waqif’s intent as far as possible is necessary, while going against it is prohibited. However, if the first place becomes deserted, then moving to another place and changing the name are all permissible, since in this there is protection against loss.
