Setting up an Islamic school by usurping possession
Question
Adjoining the mosque a building has been constructed. In the government partition that took place on 18 May 1883, this building is a square-shaped (?) imambara (a Shi‘i hall for mourning gatherings); from then until today it has continued to have the status of an imambara. From 1884 until today the Shi‘i sect has been its landlord. Now we, the Ahl al-Sunna wa-l-Jama‘a, are two groups.
Answer
Usurping possession entails great harms: it is objectionable according to the Shari‘a, and it is also a crime according to the law; there is a risk of heads being broken, and a grave danger of litigation as well. It is better to meet the landlord and come to a settlement.
