Expanding a mosque under a madrasa’s trusteeship with the madrasa’s land
Question
Masjid Chhatta is under the trusteeship (tawliya) of Darul Uloom Deoband, and its management and administration from first to last pertain to Darul Uloom. Its imam and muezzin are appointed by Darul Uloom, its cleaning and its floor coverings and canopy are arranged by Darul Uloom, and expenses on its repairs etc. are incurred by it. Because the mosque has become cramped, may land of the madrasa be taken for its expansion and the mosque expanded?
Answer
If the land is for the needs of the madrasa, and in the view of the madrasa’s people the mosque needs to be expanded, then it is permitted to include this land in the mosque and expand it.
