A Dispute Concerning a Madrasa

Question

A waqif (endower) made his house a waqf for a madrasa and handed it over to the Memon jama‘at (community) on the following conditions: (1) children of Ahl al-Sunna wa al-Jama‘a are to be taught in the madrasa; (2) no fee is to be charged for the teaching; (3) English education is not to be given in the madrasa. The madrasa ran on these conditions for about sixty years. Recently the Memon jama‘at has had a new building constructed for the madrasa and has returned this madrasa to the mutawalli (trustee).

Answer

It should be handed over to whoever can arrange for the teaching of the Noble Qur’an and religious education, so that reward continues to reach the waqif and the madrasa is set running again. (2) If there is no means of income, teaching should be arranged in the upper part and the lower part let out on rent, so that the needs of the madrasa can be met from its income. (3)
