Exchanging the Land of an Eidgah
Question
There is a plot of land on which there is a small, insufficient Eidgah (ground for the Eid prayer). It is surrounded on all four sides by agricultural land, and the wall of the Eidgah also needs repair; the opinion of the worshippers is to rebuild it. At some distance from this land of the old Eidgah there is another, cultivated piece of land, approximately three times as large in area, adjoining a canal and lying by the roadside, which is being offered in exchange free of charge.
Answer
If the former Eidgah is a waqf, then exchanging it is not permitted. If an Eidgah is built in another, spacious place for performing the Eid prayer, then this former Eidgah will also remain a waqf: let an orchard be planted on it and its income be spent on the needs of the new Eidgah.
