Building a Madrasa on the Land of an Eidgah
Question
In the village of Sultanpur there are two or three bighas (a local unit of land area) of the Eidgah’s (ground for the Eid prayer) land lying unused, on which people dump dung and the like. May a religious madrasa be built on this land or not?
Answer
If that land belongs to the Eidgah and there is no need to include it in the Eidgah, then build a religious madrasa there, but fix a rent for the land in favour of the Eidgah. The land will remain the Eidgah’s, the madrasa will keep paying rent for it, and the building will remain the madrasa’s.
