Performing Wudu While Sitting on the Mosque Wall
Question
The wall of the courtyard of the neighbourhood mosque had a rounded, sloping (“fish-back”) top. The headmaster of the school of the neighbourhood society, who is a hafiz, a qari and an ‘alim, has the upper part of the southern wall broken down and made flat and square; he himself performs wudu sitting on this wall, and other people also perform wudu sitting on it. Is it permissible according to the Shari‘a to do so?
Answer
In itself, wudu there is valid, provided the water of wudu does not fall into the mosque; however, the head teacher had no right, on his own and without consulting the mutawalli (trustee) and the worshippers, to make this alteration (tasarruf) to the wall of the mosque.
