A Mosque Servant’s Entitlements Are Not Inherited
Question
(1) In the Friday mosque (jamiʿ masjid) of a small town, Zayd’s grandfather and father had been appointed as muezzin and imam. After the death of the grandfather and the father, Zayd could not take their place, so other people were appointed as muezzin and imam. However, the same privileges that the town had at that time provided for Zayd’s grandfather and father were kept in place for Zayd.
Answer
(1) If some servant of the mosque (a muezzin, an imam) is given privileges on account of his service to the mosque, they remain confined to the person of that servant — or rather, to his service. Inheritance does not apply to them, such that after the servant’s death his heirs too could demand the privileges on the basis of entitlement.
