Spending One Mosque’s Money on Another Mosque

Question

The government takes the waqf money of all the mosques of India. We want this money to be spent on communal works, such as opening a college or opening a hospital. The question is: may the money of one mosque be put into other mosques or not?

Answer

Whatever has been endowed for a particular purpose must be spent on that very purpose: [ar]شرط الواقف كنص الشارع[/ar] “The condition of the waqif is like the text of the Lawgiver.” This is stated explicitly in the books of fiqh. Spending contrary to the intent of the waqif is not correct.
