Spending Usurped Property on a Mosque and the Like
Question
The inheritance of a poor man, namely a certain property, was taken by some deception or by force. May the one who took this property by force give it to his son, or to someone of his own community or a relative, or to a mosque, or not? And may he use it himself or not?
Answer
Since it was taken without a Sharʿi right, it is necessary to return it to the original owner. Without the owner’s permission it is not permissible to spend it oneself, or to give it to any relative, or to spend it on a mosque.
