Does privately owned land become masjid dirar if congregational prayer was held on it?
Question
About 70 years ago in my village, between two witnesses (?) of two enlightened-hearted spiritual guides, tension arose in the Jami‘ Mosque over some issue, because of which one group, temporarily and in order to avoid a clash, performed its prayers in a large house. This continued for some time, after which agreement and unity were restored between the two groups, and they again performed their prayers together in the Jami‘ Mosque.
Answer
If this house was not made waqf and the owner did not relinquish his proprietary possession, but prayers were merely held there temporarily for some days, then it did not thereby take the ruling of a mosque in the Shar‘i sense; rather, it is the property of the owner, and there is no right to evict him by force.
