A new mosque is not a masjid dirar

Question

In Jhar Bashla (ژاڑ بشلا) the people of the neighbourhood built a thatched mosque on the north side of a house, at a distance of 8–9 cubits from it, and for about 28–29 years they performed the Friday prayer and congregational prayer in it. To the north-east of the mosque there is also a public meeting house, situated such that there is usually a crowd of common people and notables there day and night.

Answer

Since the second mosque was built because of the said need, the owner of the land gladly gave that place for the mosque, prayer and congregation began to be held there regularly, and the original owner’s proprietary possession over it did not remain, it has become a mosque in the Shar‘i sense; it does not fall under the ruling of a masjid dirar.
