Inheritance of the office of qadi and a waqf for a specific family
Question
O successor of the Master of both worlds ﷺ, please tell us — may the Generous Lord grant you good success — is the office of qadi (judge) anything at all? If it is, can its true heir (that is, one who is God-fearing and pious) be the heir and owner of his right, when no conditions of a waqf or the like attach to it and none exist?
Answer
In an Islamic state, appointing a qadi to decide the cases of the subjects, to oversee the rights of those who have no heirs, and the like is legitimate (mashru‘). Its conditions are set out in the books of fiqh.
