(Extracting a kullama oath by force) The oath of a minor. Expiation for an oath
Question
Zayd is a very hot-tempered man. By intimidating him with his anger he made a boy aged 13, 14 or 15 swear: «اگر کوئی بات میں آپ سے پوشیدہ رکھوں تو میری بیوی پر جب میں شادی کروں طلاق ہے، پھر جتنی مرتبہ میں شادی کروں اتنی ہی مرتبہ طلاق پڑے» (“If I conceal anything from you, then upon my wife, when I marry, there is talaq; and however many times I marry, that many times may talaq fall”) — although, far from this boy’s marriage, not even an engagement has yet been settled anywhere.
Answer
(1) This is oppression (zulm). (2) If the boy is a minor, his oath is legally not valid; and if he is an adult (baligh), his oath is valid. If he has nocturnal emissions (ihtilam), or he is a full fifteen years old, then he is an adult. (3)
