Talaq by the Words “I Separate This Woman from Myself”
Question
Question: What is the ruling of the Pure Shari‘a in the following matter? Zayd said before the community council: «اس عورت کو میں اپنے سے پنچوں کے سامنے الگ کرتا ہوں» (“This woman I separate from myself before the members of the community council”), or «اپنے سے الگ کرنا چاہتا ہوں» (“I want to separate her from myself”). His wife was not in the house where the people had gathered; rather she was in a neighbour’s house in the same neighbourhood.
Answer
«الگ کرنا چاہتا ہوں» (“I want to separate”) is an expression of intent and wish; talaq does not occur by it. «اپنی عورت کو پنچوں کے سامنے اپنے سے الگ کرتا ہوں» (“I separate my woman from myself before the members of the community council”) is one of the allusive (kinaya) expressions of talaq: if Zayd said these words with the intention (niyya)
