The ruling on the words “There is no relation between me and you”

Question

A man gave his wife talaq once, or said: “تجھ کو میں نے آزاد کی” (“I have set you free”), or said: “میرا تیرا کچھ واسطہ نہیں” (“There is no relation between me and you”). In short, if he said any one of these three expressions, has talaq befallen the woman or not? What is now the Shar‘i ruling for the woman?

Answer

If he gave talaq with an explicit (sarih) word, talaq has taken effect, whether he had the intention (niyya) or not. And the expression “میں نے آزادی کی” (“I have given freedom”) is, in our custom (‘urf), equivalent to explicit; by it too a single revocable (raj‘i) talaq takes effect without intention.
