Disrespecting the Qur’an and Leaving One’s Wife at Her Parents’ Home

Question

Question: A man took the noble Qur’an from in front of his wife while she was reciting it, threw it elsewhere with great disrespect, and said: “What is the use of reading such a Qur’an and praying — it is all useless.” Then he said: «تو میری اماں ہے، مجھ کو تجھ سے کوئی کام نہیں، تو اپنے ماں باپ کے یہاں چلی جا» (“You are my mother; I have nothing to do with you; go to your parents’ home”). After this, the man himself left his wife at her parents’ home. A year has passed and he has not enquired about her at all.

Answer

Showing disrespect to the Noble Qur’an is a most grievous sin; by it faith (iman) departs. When he said to his wife, “I have nothing to do with you; go to your parents’ home” — did he intend talaq by it or not? If he said it with the intention (niyya) of talaq, then talaq has taken effect, and after the ‘idda a second nikah is valid for the woman.
