Giving and Taking Specific Items at the Engagement

Question

(1) What is the ruling when, before the marriage contract ('aqd), the girl’s side takes sweets and the like from the boy’s side — with a condition or without a condition on the basis of custom ('urf) — and the boy’s side gives it willingly or under compulsion? (2) Is fixing the day of the wedding gifts permissible or not?

Answer

(1) [ar]أخذ أهل المرأة شيئًا عند التسليم فللزوج أن يسترده لأنه رشوة. الدر المختار. قال الشامي: قوله: «عند التسليم» أي بأن أبى أن يسلمها أخوها أو نحوه حتى يأخذ شيئًا، وكذا لو أبى أن يزوجها، فللزوج الاسترداد قائمًا أو هالكًا لأنه رشوة. بزازية[/ar] “If the woman’s family took something at the handing over, the husband may reclaim it, because it is a bribe (rishwa)
