Marriage to a Girl Born Unlawfully and to the Daughter of the Wife’s Paternal Half-Sister
Question
The offspring of the second wife in a case of “in tajma‘u bayna al-ukhtayn” (“combining two sisters”): is the marriage contract and nikah of a believer with such a girl permissible, on the part of people who are strangers to them and have no connection with their kinship — whether in ignorance of the circumstances or with knowledge of them? Is nikah with the children of the wife’s paternal half-sister, i.e. with the daughter of such a brother-in-law (the husband of the wife’s sister), permissible or not?
Answer
If some girl was born in an unlawful way, the marriage contract (nikah) with her is not haram, provided there is no prohibiting relationship with her. As long as the wife remains in the nikah, nikah with the daughter of her half-sister is not permissible.
