Nikah with One's Paternal Aunt

Question

Is nikah with one's full paternal aunt, i.e. the father's sister, permissible or not? If someone contracts nikah with his full paternal aunt, what is the ruling for him?

Answer

Nikah with one's full paternal aunt is categorically (qat‘an) haram. Therefore, if the one contracting this nikah does so knowing this ruling, then, according to the rule of the Shari‘a, in the view of the sahibayn (Imam Abu Yusuf and Imam Muhammad) the hadd will be applied to him, and separation (tafriq) is necessary in every case.
