Marriage to the Daughter of One’s Brother’s Wife

Question

The woman whom the elder brother has married has a daughter from her first husband. Is the younger brother’s marriage to this girl valid or not? And this woman is without a divorce (talaq).

Answer

The marriage of this daughter of that woman to the young man in whose elder brother’s house that woman is living is permissible. If this woman’s husband has not divorced her, then for the elder brother to keep this woman in his house and maintain a marital relationship with her is haram and a major sin (kabira).
