Nikah before circumcision
Question
The nikah of one named Gami, son of Jamma, took place with one named Bayan, daughter of (?). At the time of the nikah the boy was four years old and uncircumcised, and the girl was one year old. There could be no question of offer and acceptance (ijab and qabul) between the two of them; the nikah was concluded only with the consent of the parents on both sides. When both parties reached maturity, after maturity they began to live married life happily. At present the young man is 26 years old and the young woman 22.
Answer
The nikah which the father concluded at the age of four undoubtedly became valid. To call it wrong because circumcision had not taken place, and to bring about a separation between husband and wife, is not correct; by no means prevent them from meeting each other. Circumcision is a sunna and it is stressed, but the nikah does not become impermissible because of it.
