Aborting an illegitimate pregnancy does not end the nikah
Question
While Zayd was residing away from home, his wife had an illegitimate pregnancy of two to three months aborted. How many Shari‘a witnesses are needed to prove this? Once it is proven, is Zayd’s wife still in the nikah, or has it been annulled (faskh)? If it has been annulled and he wishes to keep her again, in what way will that be permissible?
Answer
Whether the illegitimate pregnancy remains or is aborted, the nikah is not annulled by it; the original nikah remains, so there is no need for witnesses — do not worry about it.
