Upon Whom Is Hajj in a Joint Business

Question

(1) For example, several brothers live a joint life and all of them earn — some through trade, some through farming — but the brothers engaged in trade earn more, so that even after meeting all the joint expenses so much money remains that every member of the household could perform Hajj. The joint household, in which they earn less than the nisab, includes people of the following kinds: this trader’s brothers and their wives, his parents, and this trader’s adult (legally mature) unmarried sons.

Answer

(1) Since all the brothers earn separately, each of them is the owner of his own earnings. Whoever has money sufficient for Hajj over and above his basic needs (hajat asliyya), upon him Hajj is fard. Their living a joint life together and helping one another is mutual sympathy.
