Does Going to Makkah Make Hajj Fard?
Question
If a person goes to Makkah and, having arrived there, performs ‘Umra on his own behalf, or on behalf of his parents or someone else, does Hajj become wajib upon him or not? If this person performed ‘Umra with the intention of reward, then surely there is no harm in that? And if he performed ‘Umra on behalf of his parents and others, does Hajj become wajib upon the parents and others or not? Secondly, if he goes with the purpose of visiting Makkah, does the sacrifice become wajib upon him or not?
Answer
If a person upon whom Hajj was not fard arrived in Makkah for the purpose of ‘Umra while the time of Hajj is also near, then Hajj has become fard upon him — whether he went for ‘Umra on his own behalf or on behalf of his parents. If the time of Hajj is not near, Hajj has not become fard upon him.
