Permission for a dhimmi in dar al-Islam to sell forbidden things in return for jizya
Question
Question: In the book Ghunyat al-Talibin (غنية الطالبين), translated by Amanullah Khan Sarhadi (publisher: Malik Publishers Private Limited, Deoband, District Saharanpur), on p. 263 it is written that if dhimmis — Jews, Christians, Magians (Majus) — wish to sell forbidden things such as swine, wine and the like, they should be given permission for it, but the collection of a tenth of the price should be fixed.
Answer
The unbelievers who live in dar al-Islam having become dhimmis have jizya collected from them, and their lives and property are protected. The sale of wine and swine is permissible in their religion, and no ban is imposed on it; rather, they are permitted to sell. This is the position of the Hanafis, which is mentioned in the books of fiqh.
