Disagreement over the Price between Seller and Buyer
Question
The butcher’s boy came to Zayd and stated the price of the meat as four rupees per seer (a unit of weight, ≈ 0.93 kg). Zayd said: “We will give three rupees per seer.” The boy began to leave but remained silent, and then came and handed over the meat; the boy said nothing. A little later he again handed over the head and trotters and stated the price as two rupees. Zayd stated a price of 4/…… (?), not more than that. What is the ruling? Zayd paid for the meat at the rate of 3 rupees and closed the matter?
Answer
The price of the head and trotters had been settled — there is no doubt about that. As for the price of the meat, Zayd fixed it on his own part and stated it — three rupees per seer — whereupon the boy, remaining silent, went and brought the meat. Hence this sale did not become defective (fasid).
