Selling Rented Land on Which a Building Has Been Erected

Question

Zayd took land from a landlord on annual rent and built a house on it; thirty years have passed since then. Now the landlord, owing to his needs, wishes to sell his land, excluding the structure. Will the sale, leaving out the structure, be permissible or not?

Answer

The owner has the right to sell his land; then the buyer will say to the tenant: “Remove your structure from here and vacate the land, or sell it to me.” It is better that the owner himself settle the matter with the tenant before selling the land, and sell after that.
