Spending zakat money on one’s own needs and replacing it from one’s salary
Question
(1) A person who collects zakat and charity funds for a madrasa on the madrasa’s behalf — the collector being needy and himself a recipient of zakat — spends some money beyond his wage and later makes it up from his own income. What is the ruling: is this permissible or impermissible? (2) What is the ruling on spending zakat funds on teachers’ salaries without tamlik (transfer of ownership) in a madrasa that has a kitchen (matbakh)?
Answer
(1) The person appointed as collector by the madrasa is a trustee (amin). Whatever zakat and charity money he collects is a trust (amana), and he has no right to dispose of it. In such a case the zakat will not be discharged, and he will be obliged to compensate (daman)
