Giving students food from the kitchen under the zakat head
Question
Respected Mufti, may your exalted glory increase!… Assalamu ‘alaykum. Your letter of reply has been received. A difficulty arises: like the other expenses connected with the students’ food, the cook’s salary is also an expense, that is, the nature of the cook’s salary is different from the expenses listed below (?), for example: the cost of bringing rations for the students, the grinding of wheat, the purchase of firewood and its splitting, and so on. Is there any difference in the nature of these expenses?
Answer
[ar](هي تمليك) خرج الإباحة (جزء مال) خرج المنفعة، فلو أسكن فقيرا داره سنة ناويا لا يجزيه. قوله: فلو أسكن... في البحر إلى الكشف الكبير، وقال قبله: والمال كما صرح به أهل الأصول ما يتمول ويدخر للحاجة، وهو خاص بالأعيان، فخرج به تمليك المنافع[/ar] “(It is tamlik, transfer of ownership) — this excludes permission to use (ibaha); (of a portion of property)
