Students giving money to a teacher upon passing an examination
Question
A man considers himself the qadi of the town; at the same time he also leads the prayer in the congregational mosque and at the two Eids, and he is also a government teacher. This man takes payment from students for getting them passed, and with the same aim in view he also takes money from students and gives it to other masters (teachers). Does this conduct of his fall under the definition of taking and giving a bribe (rishwa)? Can such a man, according to the Shari‘a, hold the above-mentioned offices?
Answer
There are two cases. One is that he takes money and gets unqualified and undeserving students passed, so that if they give money they pass, and otherwise they fail. This case is bribery and haram. Such a man is not deserving of the imamate.
